Plaintiff exited the vehicle to return home, Defendant NYPD officers Collins, Haynes, Giudice, Stelmach and Zebro exited an unmarked police car and approached Plaintiff and the vehicle's driver. Plaintiff and the driver did not do any crimes, but Defendant Zebro ordered Plaintiff without cause to stop about one half block from the location where the vehicle was parked, which Plaintiff did. Defendants told Plaintiff to go back to the car, and Plaintiff complied. Plaintiff used his cellphone to record his encounter with the officers. Plaintiff asked why he was being stopped and the officers refused to tell him. Defendant Zebro told Plaintiff that he couldn't leave and asked for photo identification. Defendants detained Plaintiff without cause. Defendants Stelmach and Zebro threw the driver on the ground and assaulted the driver while Plaintiff begged defendants to stop. Defendant Haynes shoved Plaintiff and grabbed Plaintiff's shoulders and arms and pushed Plaintiff into a fence gate, striking Plaintiff's right side of his body and pinning him against the hard surface. Defendant Haynes caused Plaintiff pain to the right side of his chest and ribs, back, right shoulder, right arm, bruising, swelling and a reduced range of motion. Defendants Haynes, Collins and Giudice surrounded Plaintiff and continued to unlawfully detain him by forcibly grabbing his person and unlawfully searching his clothing. Defendant Hayne shined his flashlight into Plaintiff's cellphone to interfere with Plaintiff's recording. Defendant Haynes shoved Plaintiff to prevent him from recording. Defendants also obstructed Plaintiff's cell phone camera. Defendants retaliated against Plaintiff for recording by detaining, searching and assaulting Plaintiff. Defendants Collins, Haynes and Zebro unlawfully searched Plaintiff by putting their hands inside of Plaintiff's clothing and grabbing his person. No criminal charges were filed against Plaintiff.
