Defendant officers stormed into the plaintiffs' home and assaulted, beat and battered them. If defendants had a search warrant for the apartment, it was issued upon the basis of extremely unreliable information, and the police did not follow NYPD policies and procedures in obtaining and executing such a warrant. Ms. Gonzales was dragged from her bedroom into the living room where the officers further abused the plaintiffs. No contraband was recovered, and the officers falsely arrested the plaintiffs. The plaintiffs were put into a prisoner van and driven around for approximately five hours. Officers misrepresented to the Bronx County District Attorney's Office that the plaintiffs had committed criminal offenses and fabricated police paperwork and documentation including arrest reports. After being held for approximately 42 hours, Gonzalez was released from Bronx Central Booking without seeing a judge, and the DA declined to prosecute her.
