During Ms. Gaviola and her mother’s stay at the Hotel, she was involved in a physical altercation with another guest of the hotel. Immediately following the incident, Ms. Gaviola called the NYPD to report the altercation. upon the NYPD’s arrival, other Hotel’s agents –defendant MICHAEL LAMARRE and defendant PAUL KASHMAN – made false statements to defendant P.O. Sergeant Kaitlin Mooney, P.O. Joseph Orlando, Shield #2340, summarily contending that Ms. Gaviola had initiated and commenced the altercation against defendant Mildred Antoine, whereas it was defendant MILDRED ANTOINE whom initiated and commenced the Attack against Ms. Gaviola. Subsequently, the defendant police officers, without warrant, probable cause, justification, consent, and/or reading Ms. Gaviola her Miranda rights, forcibly placed silver manacles upon Plaintiff’s wrists against her will, and forcibly removed her from the Hotel. Ms. Gaviola was then transported to the NYPD’s thirteenth (13th) precinct located at\n230 East 21st Street, New York, NY 10010, and held at such police precinct against her will without warrant, probable cause, justification, consent, and/or reading Ms. Gaviola her Miranda rights for over five (5) hours, criminally processed, and then issued a desk appearance.\n\nWhile she was in custody and unbeknownst to Ms. Gaviola the defendant NYPD police officers forcibly removed her elderly mother from the Hotel without warrant, probable cause, justification, and/or consent, and delivered Ms. Gaviola's elderly mother to Bellevue hospital for unknown reasons, where Plaintiff’s elderly mother was held against her will without warrant, probable cause, justification, and/or consent. Ms. Gaviola returned to the hotel to retrieve their belongings. However, upon arrival at the Hotel, she was informed by Hotel staff that her belongings and those of her elderly mother were gathered and placed into garbage bags and left curbside, and a number of the items were missing.
