In fact, before arresting Plaintiffs, the officers spoke to several witnesses at the scene who informed them that Plaintiffs were not the perpetrators. The searches yielded no evidence of any guns, drugs, or contraband. Despite the absence of any evidence of wrongdoing on the part of Plaintiffs, POs Bunch and Lam formally arrested Plaintiffs. After having been brought to the precinct and Central Booking, where they were held for hours, Plaintiffs were summarily released without explanation and without being charged when the DA’s Office declined to prosecute them. While Plaintiffs were in police custody, the officers created or caused the creation of paperwork memorializing false factual allegations against Plaintiffs in order to justify the illegal search, seizure, and arrest. The officers knew the allegations to be false when they made them.
