After Plaintiff explained that he was charging his phone, Defendant Duroc asked Plaintiff if he could search him and his car, to which Plaintiff consents. Defendants did not find anything on Plaintiff's person or his car but accused Plaintiff of driving while intoxicated, despite Plaintiff's denial. Plaintiff requested that a sergeant be called onto the scene, leading to Defendant Latavia Lawrence's arrival on the scene. Defendants Duroc and Lawrence falsely informed Defendant Lawrence that Plaintiff was drinking and driving, and, instead of making an independent assessment, Defendant Lawrence directed that Plaintiff be arrested. Plaintiff was then handcuffed and transferred to the 73rd precinct. Plaintiff requested a breathalyzer test, which he passed, but the Defendants refused to release him.
