The driver, against the will of Plaintiff passengers drove away. The cab was then blocked by an NYPD vehicle. The Defendant Officers then forcefully pulled all of the occupants out of the vehicle and place them in handcuffs before being searched. The search yielded one of the Plaintiffs prescription pain medication. That same Plaintiff needed a cane to walk, but said cane was taken from him and Defendant Officers refused to return it upon request. Plaintiff was then shoved to the ground and his feet were shackled by Defendant Officers. Plaintiff was then thrown into a police van, denied medical attention, and punched and kicked excessively without justification. The Plaintiff was knocked unconscious by the vicious assault of the Defendant Officers. The second Plaintiff was handcuffed so tightly circulation began to cut off and the cuffs pierced his skin. At the precinct Plaintiff received an unnecessary anal probe and was refused his cane or shoes. When Plaintiff Davon Rodriguzez, who suffers from developmental impairments, saw his brother get arrested and told the officers to let go of him, he was violently tackled and beaten by Defendant Officers. He then required medical emergency room treatment where he was taken by an ambulance. Plaintiff Ashley Martinez was subsequently falsely and violently arrested without a warrant or probable cause and held at the precinct without access to a working bathroom for 5-6 hours. She was falsely charged with obstruction of governmental administration in the second degree despite the Defendant Officers knowledge that she had not committed this offense. At the precinct, Plaintiff was thrown against the wall before being placed in a cell. Plaintiff asked the officers to loosen his handcuffs but the officers instead tightened the handcuffs. Plaintiff begged for a doctor but was not provided medical attention for another 2-3 hours. \n\nOfficer Oviedo reviewed and signed a criminal court complaint containing allegations he knew to be false.
