The unmarked police vehicle engaged its emergency lights and drove right by Mr. Garcia, at which point Mr. Garcia voluntarily pulled over his vehicle and waited inside his vehicle for the NYPD police officers, including Defendant P.O. Justin M. Clavell to approach him. Defendant P.O. Clavell approached Mr. Garcia, violently grabbed him from his vehicle and threw him on the street floor with so much force that Mr. Garcia broke his ankle. Defendants P.O. Clavell and/or P.O. John Doe proceeded to arrest Mr. Garcia and initiated frivolous criminal charges against him, all of which were dismissed by way of an adjournment in contemplation of dismissal (A.C.D.).
