The plaintiff, along with other protestors, yelled “Shame” and “who do you work for,\" after which Slavin aggressively approached the plaintiff and grabbed him in a headlock. Slavin then took the plaintiff down to the ground in a chokehold on the street and placed a knee on the plaintiff’s body, later handcuffing and arresting him. The plaintiff was then transported to the 17th precinct and was held in a cell for over two hours, held against his will under full force of arms. Police Offie Byran DeVita issued a summons, falsely accusing the plaintiff of disorderly conduct for obstructing vehicular traffic, which was later approved by Slavin. All charges against the plaintiff were later dismissed. The plaintiff was thus falsely imprisoned without cause or any reasonable grounds; the plaintiff was wholly innocent of all criminal charges and did not contribute in any way to the false arrest and imprisonment. The plaintiff was lawfully at the protest, exercising his constitutional right freedom of speech and his right to assemble ad associate. The plaintiff consequently suffered great emotional and psychological harm, as well as loss of work and freedom.
