The defendants' fabrication of the situation led the District Attorney's Office to charge the  Plaintiff with the Sale of a Controlled Substance in the Third Degree and the Plaintiff's detainment for 41 months until his release from prison on or about November 16th, 2017. They struck Plaintiff's head with a handgun and repeatedly struck his head with a baton. They threatened to shoot and kill Plaintiff while he was still in his car. Defendants handcuffed Plaintiff's left hand to the interior of the car door and his right hand to the steering wheel, continuing to strike him even after he was handcuffed. Plaintiff sustained multiple injuries and was taken to the precinct. Plaintiff was charged with attempted tampering with physical evidence and criminal possession of a controlled substance in the seventh degree. Detective Baez falsely provided information to the court swearing he had observed a separately charged defendant sniff heroin after obtaining it from Plaintiff's hand and sweater.
