Plaintiff heard a loud noise, screaming, and people yelling to get on the floor. Plaintiff was scared and ran out of the backyard, jumped over a fence, and hid. The loud noise was the result of a no-knock warrant that NYPD officers had executed at a different apartment than the one Plaintiff was visiting. The defendant officers pursued Plaintiff and approached him with their weapons drawn. Plaintiff surrendered, on his knees with his hands behind his back. The officers tackled Plaintiff to the ground from behind, forced his face into the ground, and then punched and kicked him. Plaintiff begged the officers to stop, but they did not. The officers fractured Plaintiff’s wrist. One of the officers then put Plaintiff in a “submission hold,” with his knee on the back of Plaintiff’s neck. The officers searched Plaintiff but did recover anything. Plaintiff was arrested and charged with multiple counts of illegal possession. \n\nPlaintiff was transported to the precinct. He repeatedly requested the officers remove or loosen his handcuffs due to his wrist pain, but they refused. The officers refused to pursue medical treatment and instead sent Plaintiff to Central Booking. On April 8, 2015, all charges against Plaintiff were dismissed. The arrest, however, had triggered a parole violation. Plaintiff was sent to Rikers Island. An initial examination erroneously found that Plaintiff had only a wrist sprain, so Plaintiff was not given medical treatment and was sent to a general population unit. Without the ability to defend himself, Plaintiff was a target of violence and theft. On April 15, Plaintiff’s wrist was finally set with a cast.
