Detectives Perez and Zamot caused a malicious prosecution to be commenced against Plaintiff. On April 3, 2019 a jury dismissed all charges against Plaintiff after a three-and-a-half-week trial. The actions of the detectives caused Plaintiff to be wrongfully incarcerated for approximately 25 days. As a result of this incident Plaintiff sustained personal, physical, and emotional injuries including shock, fear, and professional and economic losses. Redd was the father of the child Delain was carrying. NYPD arrived and interviewed Redd and Wimms, as well as the resident in the apartment above Delain, who said she had not heard anything and didn’t know the apartment was even occupied. Redd accompanied the detectives to the precinct and cooperated fully without invoking his right to counsel While at the station, Edward Balfe, Ronald Waldron, and Billy Milan interrogated Redd unlawfully and falsely claimed Redd made certain statements to him. During this, P.O. Fresnel was in the interview room with Redd, she offered false statements in a report about what Redd said in the back of the police car in order to secure an arrest. Redd was interrogated for a total of 24-28 hours before he was released without being charged. \n\nA week after the murder, Detectives Waldron and Milan stated that the neighbor above the apartment and changed her testimony to indicate she heard a commotion in the apartment downstairs and heard someone say “Stop Derrick.” P.O.s who were unknown coerced at least two other witnesses to falsely incriminated Redd by offering them cash and other compensation and/or with threats. There is no evidence connecting Redd to the crime or any probable cause for his arrest. The neighbor upstairs was given a host of benefits to secure her perjured testimony including but not limited to assistance with relocation to a new apartment, assistance with her immigration status, and assistance in obtaining a new job.\n\nOn November 17, 2008, Redd was arrested by Balfe and charged with murder, criminal possession of a weapon, and abortion. This arrest was unlawful. On January 4, 2012 Redd was convicted. On July 6, 2026, the Appellate Division reversed the conviction due to pervasive prosecutorial misconduct and ordered a new trial. During the investigation for a new trial, the police questioned Shaqira Pollar, the mother of Redd’s son. They attempted to obtain her testimony against Redd by claiming that Redd was involved in her ex-boyfriend’s murder. \n\nOn April 4, 2018, Redd was acquitted of all charges after a jury trial.
