They allege that the Defendants violated their constitutional rights by subjecting them to inhumane conditions of confinement. These conditions include:\n(1) overcrowding - Plaintiffs were packed into overcrowded cells, often forcing them to only have space to stand for hours. When the space opened up, Plaintiffs were forced to sit or lie on filthy hard ground. The benches found in some cells were insufficient to accommodate the crowd. \n(2) unsanitary toilets - The exposed toilet in each call at BCD lacked a seat, lid or sufficient privacy. The toilets were often covered in feces, vomit, urine and other excrement. The toilets frequently clogged and overflow. BCD officers would ignore requests for toilet papers.\n(3) garbage and inadequate sanitation - Garbage, feces, urine and other excrement were splattered on the floor of the cells. Majority of the Plaintiffs did not observe anyone cleaning up the cells during their detention. When they do, it would be a quick superficial cleaning.\n(4) infestation - Most of the Plaintiffs were put in cells which were infested with rodents, cockroaches, flies and other insects.\n(5) lack of toiletries and other hygienic items - Plaintiffs were not provided with basic toiletries, such as soap, tissues, hand sanitizer, toilet papers.\n(6) inadequate access to food and water - Plaintiffs were not provided with fresh and clean drinking water. Most of the water available was from a sink adjacent to a filthy toilet. Adequate food was not provided. Food were usually moldy, rotten, stale, expired or otherwise inedible.  \n(7) extreme temperatures and poor ventilation - Most Plaintiffs were subjected to extremely cold or hot temperatures while held in BCD. The cells also lacked ventilation.\n(8) sleep deprivation - Plaintiffs were not provided with any sleeping provisions such as mats, beds, cots, pillows or blankets. Some of the Plaintiffs were so desperate they slept on the filthy hard floor or benches in the cells. \n(9) crime and intimidation - The cells held violent criminals and minor offenders, which subject the wear detainees to threats and assaults by others. Plaintiff informed the officers, including Morales, that he is a Type 1 diabetic and needed insulin. The officers ignored his request. At the precinct and central booking, Plaintiff repeatedly requested the officers and practically begged to get him to the hospital; the requests were either ignored were rejected. His request for water was also denied. Plaintiff stayed in central booking for the whole night before he was taken to the hospital when he collapsed to the floor. As a result, Plaintiff developed serious complications from diabetes called \"Diabetes Ketone Acedosis\". Plaintiff developed a serious infection in his feet requiring him to remain in the hospital for 4 days and was shackled to the bed by his wrists and ankles this whole time. After being discharged from the hospital, he needed medical treatment soon after. He tried to explain to the officers that if he was not taken to the hospital he could become gravely ill, but he was again taken to central booking and placed in a cell. Plaintiff became violently ill and was taken to the hospital again. During Plaintiff's hospital stay, the officers failed to forward or to have an individual under their command forward the paperwork necessary to schedule an arraignment of Plaintiff at the hospital. Plaintiff was taken behind the police car and handcuffed. Police Officer Eltabib and Police Officer John Sanchez arrived on the scene. Eltabib, without cause, shoved plaintiff, causing him to fall backwards. The other officers failed to intervene. Plaintiff, who has sickle cell anemia, was in severe pain and breathing heavily after the hit and asked to be taken to the hospital 15-20 times but was denied. Plaintiff was taken to the precinct but was not immediately taken to the hospital after telling the officers he suffered from sickle cell anemia. Later, he was eventually taken to Coney Island Hospital. \n\nPlaintiff was hospitalized from June 16 to June 27. For his entire stay in the hospital, plaintiff was handcuffed to the bed with his feet shackled together. During his stay in the hospital, plaintiff was mistreated by the officers. For example, they often made his handcuffs too tight and did not loosen them when he asked, they made him wait up to 45 minutes after he had said he needed to go to the bathroom, and they interfered with his treatment in the hospital. At the hospital, plaintiff was informed that he did not actually have a suspended license, and instead of two warrants, there was only one for open container.  Further, the officers failed to arraign the plaintiff until 11 days after he was taken into custody. Officer defendants subsequently arrested plaintiff and placed tight handcuffs on him without stating the cause for arrest. The aggressive tactics and language of the officer defendants put plaintiff in a state of stress and panic which triggered an asthma attack. His pleas for assistance with this attack were ignored despite other witnesses expressing the possibly fatal nature of plaintiffs health. Once at Brooklyn Central Booking, plaintiff experienced poor conditions such as extreme cold, a lack of beds and sleeping equipment, overcrowding, and exposure to human waste, insects and garbage.
