Defendants ordered Plaintiff to come downstairs to the first floor in her pajamas, during a time when she was recovering from a double mastectomy and bilateral breast reconstructive surgery. Defendants were searching the premises where Plaintiff's brother's family resides, and plaintiff inquired if they had a warrant. Defendant replied that she had no business there and to go back upstairs, with expletives. Plaintiff said her question was valid and that she was going to call her brother in law who was a retired Detective to see what the proper procedure would be. Defendant Detective Avery grabbed Plaintiff by the neck and forced her right arm painfully behind her back and high in the air, which was particularly painful given Plaintiff's recent surgery. Plaintiff was then thrown onto a couch and subsequently onto the floor. Defendant Detective Avery sat on Plaintiff's back and forced her body against the floor, at which point Plaintiff's sister in law informed the officers that Plaintiff was recovering from surgery. Despite this, Plaintiff continued to be restrained in this way and screamed in agony for approximately ten minutes. Plaintiff was threatened with arrest, but the defendants eventually left without taking further action.
