When Mr. Leckie gained control, the person ran away. Before Mr. Leckie could register what had happened, Officer Gonzalez arrived and pointed his weapon at Mr. Leckie, telling him to get on the ground and stomping on his back, applying pressure such that it was hard to breathe. Officer Robinson was radioed to the scene. Mr. Leckie explained that he was the victim and had been cut and was taken to the hospital. After the hospital, he was taken to the precinct where he explained to Officer Robinson that he had been assaulted. Robinson said: \"Don't worry, it's just a simple assault charge\" to which Mr. Leckie protested. Robinson informed him that the person he had fought with had also been cut and was also detained and being processed. The next day, Mr. Leckie's attorney informed him that Mr. Leckie was the only one arrested and was being charged with assault in the second degree with a knife.
