Brown also claimed that he personally recovered a hot crack pipe containing residue from Mr. Miller’s left front pants pocket. Additionally, Brown alleged that Defendant Payano informed him of stopping SCD Gelsomini and recovering two twists containing crack/cocaine from his fanny pack. He further alleged that Defendant Assent informed him of recovering $27 from Plaintiff Lamont Brooks’ left front pants pocket and marijuana from his right front pants pocket. \nThe Defendants also unlawfully engage in excessive, unlawful physical contact with the Plaintiff on the same day during the process. For approximately six days, the individual Defendants and others falsely stated and swore that Plaintiff committed criminal acts constituting the sale of a controlled substance in the third degree. They maintained those false claims in documents given to prosecutors that led to Plaintiff’s prosecution.  Only when Plaintiff's criminal defense attorney obtained video footage during the course of the criminal prosecution was the case dropped and Plaintiff's liberty restored.  Plaintiff was continuously kept in unlawful police custody until August 22, 2017.
