While he was looking for the item, POs Daniel Gillen, Sgt. Marco Martinez, Lt Steven Weiss, and other unnamed officers surreptitiously approached Plaintiff from behind with their guns drawn and pointed at Plaintiff's head, and proceeded to unlawfully stop, seize, and detain Plaintiff without legal justification. Plaintiff returned to the driver's seat, knowing there was no legal justification to suspect or detain him. Plaintiff began to find his phone and POs asked him what he was doing. Plaintiff responded he was trying to find his phone to call an attorney. POs, angry with the fact that he wanted to speak with an attorney, forcibly opened the car door, dragged Plaintiff from his car, and arrested him with excessive force, causing Plaintiff injuries and contusions all over his body. \n\nPlaintiff was falsely charged with multiple offenses and unlawfully taken to the 71st Precinct. POs also unlawfully seized Plaintiff's car and conducted an illegal \"inventory search\" on it in an attempt to find contraband, prying open closed and sealed containers in the trunk of Plaintiff's car with a knife. POs falsely claimed to have recovered illegal drugs and weapons from these containers. Plaintiff was subjected to a malicious prosecution on the basis of these claims and was compelled to hire an attorney for $2,500 to defend against the false charges. Plaintiff was released from custody on May 16, 2014 after approximately 24 hours in police custody, and was thereafter forced to return to court numerous times before Plaintiff was ultimately acquitted on April 29, 2015.
