The officers pointed their guns at Stephanie Jimenez, Mark Julien and Malcolm Johnson. Officer Paul Fazio unlawfully struck Mr. Johnson with a tactical shield, calling him to fall to the ground. The officers, including Officer Fazio, then handcuffed Mr. Johnson, grabbed him and detained him for an unreasonable period of time, without cause. The officers also grabbed Mr. Julien, slammed him to the ground, and placed severely over tight handcuffs on his wrists, without cause. The officers also handcuffed Ms. Jimenez, without cause. The officers removed Ms. Jimenez and Mr. Julien from the apartment in handcuffs, put them in a police vehicle, and took them to the 120th Precinct. They were kept there until the following day. They were released following their arraignments in Richmond County Criminal Court on baseless charges. \n\nMs. Jimenez had to return to court for approximately eleven appearances. On August 6, 2012, all charges levied against Ms. Jimenez were dismissed and sealed. \n\nMr. Julien had to return to court for approximately seventeen appearances. As Plaintiffs backed out of the gas station in their car, Defendant Police Officer Flavio and John Does stopped them. Defendant Police Officer Flavio and John Does ordered Plaintiffs out of the car, and searched the car without Plaintiff's consent.  Defendant Police Officer Flavio and John Does  also searched Plaintiffs person, including inside their pockets and their bags, without their consent.  Defendant Police Officer Flavio and John Does aggressively asked if Plaintiffs smoked weed, and verbally insulted Plaintiffs.  Defendant Police Officer Flavio and John Does then arrested Plaintiffs for supposedly possessing a controlled substance.  Defendant Police Officer Flavio and John Does handcuffed Plantiffs (with excessively tight cuffs) and placed them in a police van, where they were held for two hours.  Defendant Police Officer Flavio and John Does then took Plaintiffs to a police precinct on Staten Island and them overnight. One Plaintiff suffered from asthma and repeatedly requested his inhaler (which  Defendant Police Officer Flavio and John Does had taken), but his requests were ignored. \n\nPlaintiffs were ultimately released from police custody with Desk Appearance Tickets.
