Others in the dropped their bags and ran, and plaintiff, who feared she would be associated with their contraband, fled as well. Plaintiff, trying to flee an illegal arrest, tried to scale a fence and was caught in barbed wire. Officers caught up and refused to administer aid, leaving plaintiff in pain. At the building, officers had recovered a gun and pistol, but never saw plaintiff have possession of the bar or try to determine from plaintiff or other witnesses who owned the gun. Yet, Officer michael Guradino placed plaintiff under arrest for the gun. \nPlaintiff was taken to the hospital, where she was handcuffed while receiving medical treatment. Plaintiff was then charged with felony possession of a gun. Officers witheld exculpatory material from a grand jury and plaintiff was indicted. Over 8 months, plaintiff was on trial for the charges and had to miss 16 days of school as a result. One of the Defendant officers picked up a set of keys from the table and pushed them towards William Spivey, who then pushed them away and stated that they did not belong to him. Defendant officers grabbed William Spivey, slammed him to the ground, handcuffed him, dragged him to a police vehicle, imprisoned him therein, and punched him in the face. In retaliation for Eric Spivey’s attempt to record his brother’s abuse with his iPod, a defendant officer smacked the iPod out of his hand and shoved him to the ground. After which, at least two defendant officers grabbed Eric Spivey, slammed him to the ground, and handcuffed him. The defendant officers imprisoned Plaintiffs until May 21, 2012, when Plaintiffs were arraigned on baseless charges filed by Defendant officers with the objective of covering up the above mentioned acts of brutality and abuse of authority. Specifically, Defendant officer Doxy swore to false allegations that William Spivey was drinking alcohol from an open container, and; that when Defendant Doxy attempted to arrest Plaintiff William Spivey, William Spivey charged at Doxy and attempted to knock Doxy to the ground. Moreover, Defendant Doxy swore to false allegations that Plaintiff Eric Spivey attempted to interfere with the arrest of Plaintiff William Spivey by charging at Doxy and swinging his fists at Defendant Zeikel. Several officers, including Defendants, handcuffed Plaintiff and forced him into a police van. Defendant Kashinsky then tightened Plaintiff's handcuffs excessively; and when Plaintiff requested that they be loosened, a Defendant Officer laughed and said \"good one.\" Plaintiff requested medical attention several times, but those requests were denied.  When they finally arrived at the precinct, the officers falsely informed employees of Kings County District Attorney's Office that they observed Plaintiff obstructing governmental administration, engaging in disorderly conduct, and resisting arrest.  Plaintiff was taken to Brooklyn Central Booking and was subsequently arraigned in Kings County Criminal Court and then released,  After three additional court appearances, the charges were adjourned in contemplation of dismissal.
