Plaintiff suffered great and permanent bodily injury in and about her head, neck, back, body and limbs and was rendered sick, sore, lame and disabled, and suffered conscious pain and suffering, and that she was otherwise damaged. On the above mentioned date, Plaintiff Emanuel Garland  was without just cause, probable cause or provocation, and with reckless, negligent and callous disregard for the truth, and without investigation, touched, grabbed, handcuffed, seized and arrested Plaintiff in an excessive manner and with excessive force by the defendant officers above-mentioned. Plaintiff Garland was also fingerprinted and photographs without his consent, strip searched and held on various criminal charges at various police stations, correctional facilities and at the Courthouse located at 215 East 161 Street, Bronx, NY. Plaintiff Garland suffered bodily injury in and about his head, neck, back, body and limbs and was rendered sick, sore, lame and disabled, and suffered conscious pain and suffering, and that he was otherwise damaged. Officers Nadien Nazario and Dilma Marte approached the brothers and told them not to stand in front of the building. The brothers began to walk away. Officers Francis Conejo and Brian Forshey pulled up to the scene in a squad car and asked the other officers what was going on. Officer Conejo got out of the car and yelled at the Plaintiff’s brother, “Are you having a good day?” His brother responded that he was “except for you guys bothering me.” Officer Conejo then returned to the car. He and Officer Forshey followed the brothers and asked the Plaintiff’s brother “what did you say?” They got out of the car and told the brothers to get against the wall. The Plaintiff got against the wall and said “You can’t do this, we got rights.” \n\nOfficer Conejo started cursing at the Plaintiff and told him to “take a fuckin’ walk” and said to “arrest him.\" Officer Forshey forcibly twisted the Plaintiff’s arm and handcuffed him. Officer Nazario punched him in the stomach, grabbed him by the scrotum and pulled down forcefully, then sprayed mace into his nose. While the Plaintiff was on the ground, the officers kicked his stomach and side and punched him in the head. Then they slammed him into the back of the car and took him to the precinct, where the Plaintiff began coughing up blood. He was brought to the hospital and treated for a rib contusion and head injury. The Plaintiff spent around 21 hours at Central Booking and was charged with Resisting Arrest, Obstructing Governmental Administration and Disorderly Conduct.
