Plaintiff wasn't engaged in any activity that was criminal or unlawful. As a result of being thrown to the ground, Plaintiff suffered serious physical injury and pain to his right ankle, chest, ribs and body. Plaintiff was transported to the 44th precinct where he paced into a cell with other male prisoners. He was strip searched and nothing illegal or unlawful was recovered. After being held for several hours, Plaintiff was transferred to Bronx County Central Booking. On July 6, 2024, Plaintiff was arraigned and charged with Disorderly conduct and Resisting Arrest. Plaintiff was released on his own recognizance and ordered to return to court.
