Prior to this, the baby had spent her first few days in the NICU and also suffered from genetic heart and bone issues. After initial assessment, the matter was diagnosed as SIDS, since the baby had no external trauma or signs of internal bleeding/hemmorrhaging. Later this day, an opthamology report and CT scan showed hemorrhaging in her eyes, evidence of a sinus infection, and most significantly a skull fracture—though the data suggested this was an old fracture. By evening, the case had been assigned to the NYPD on suspicions of child abuse. By the evening, Plaintiff and husband were not permitted to see their daughter, were subjected to multiple interrogations and searches of their home by three separate squads (Defendant officers), forensic interrogations by several medical personnel at the hospital, and were treated with suspicion and unconcealed and unrestrained racism. Defendant officers screamed at the Plaintiff and husband that they killed their daughter, telling them that the hospital would not be able to help their baby if they did not admit that they caused the injury. After the baby's death, Defendants refused to disclose what had become of the baby's body. Furthermore, the Defendant hospital did not provide a sound medical diagnosis—ignoring the baby's prenatal history, family history, or genetic diseases—and instead defering to Defendant officers' assesment of the situation. Plaitiff was ordered to remain in and about her home until being arrested and imprisoned on March 11, 2008, nearly five months later on the charge of Shaken Baby Syndrome. There was no medical evidence to support the finding of SBS.
