On certain dates prior to April 12, 2023, Mr. Mushiev complained to the City of New York and NYPD that his roommate was dangerous and a threat to his safety and well-being. However, NYPD officers ignored or refused to heed Mr. Mushiev's pleas and refused to arrest Lennur Mamutov or take any action thereby. Fearing for his safety and well-being and having no respite from the NYPD, Mr. Mushiev changed the locks on his apartment door to prevent Mr. Mamutov from entering. \n\nIn the early morning hours of April 12, 2023, Lennur Mamutov, unable to gain access to the apartment, complained to the NYPD. Officers then forced Mr. Mushiev to give entry to Lennie Mamutov despite his protests. NYPD officers immediately departed, and Lennie Mamutov began to assault Mr. Mushiev. The neighbors started calling the police to warn them of the continuing assault shortly after 2 a.m., but the NYPD failed to heed these warnings. At approximately 7:20 a.m., another urgent call was made to 911 regarding the ongoing assault. At approximately 8 a.m., NYPD officers arrived at the apartment to find Mr. Bushiev beaten, stabbed, assaulted and in dire need of medical attention.
