After clearing security procedures, they were admitted to a visiting room to see their friend. Each shook hands with their friend, but no other contact was made. After about 30 minutes, Correctional Officers (Michael Moes) ended the visit, but continued to hold Mr. Nelson and Mr. Luna for approximately two hours. They did not allow Mr. Nelson access to the bathroom, forcing him to instead urinate in a bottle. Four NYPD John Does (upon information and belief: Miszuk, Tkaczuk, Frangatos and Cortes) arrived. One of the Michael Moes told them that he thought he saw, but did not actually see, Mr. Nelson pass something to his friend. Lt. Tkaczuk made the decision to arrest Mr. Nelson. Mr. Luna was allowed to leave.\n\nThe officers took Mr. Nelson out of the facility and brought him to a local police precinct, where he was subjected to a strip search by Officer Miszuk at the direction of Officer Tkaczuk. No contraband was found. Mr. Nelson was told he would not be able to visit his friend for the next six months. Mr. Nelson was held in a cell for several hours, processed and taken to Queens Central Booking, where he was arraigned and wrongfully charged with promoting prison contraband and marijuana-related offenses. Officer Miszuk falsely alleged that a Correctional Officer observed Mr. Nelson pass a plastic bag of marijuana to his incarcerated friend. Nelson went to jail at Rikers Island for one week until making bail. Plaintiff later learned the individuals in the car were POs Adam Palmer, Mateusz Tkaczuk, Nicholas Virgillo, Sgt. Damian Scanlon, and/or POs 1-10. The POs exited the car, approached Plaintiff with aggression, threw him forcibly against a brick wall without legal justification, punched Plaintiff in the face, threw Plaintiff on the ground, and continuously kicked and punched Plaintiff. Plaintiff was then handcuffed with excessively tight cuffs and taken to the 6th Precinct. Plaintiff was at this time bleeding profusely from his face and head, and requested medical attention. Due to the incident and his injuries Plaintiff was forced to miss one week of work, and had to continue to seek medical treatment for the injuries inflicted on him by POs.
