Valand, began banging on the driver’s side window of Plaintiff’s vehicle. Valand, not in a police uniform, told Plaintiff he was a police officer but did not produce a police badge. Valand asked Plaintiff for his driver’s license, which Plaintiff produced. Valand asked Plaintiff to step out of his car and told Plaintiff that he was going to search Plaintiff. Numerous other plain-clothes defendant officers descended on the scene and without Plaintiff’s consent, began rummaging through Plaintiff’s vehicle, throwing his belongings about. The officers continued impermissibly searching Plaintiff’s person, revealing Plaintiff had a utility knife in his pocket, which Plaintiff had been using to tape his bicycle. Plaintiff was ordered to the back of his vehicle where he was handcuffed and placed under arrest. Following an extended stay at the precinct, Plaintiff was transported to Central Booking for arraignment. After arraignment, Plaintiff was transported to Riker’s Island. After spending about 24 hours at Riker’s Island, Plaintiff was taken to Elmhurst Hospital. After spending a few days at Elmhurst Hospital, Plaintiff was transported to Bellevue Hospital where he spent about thirty days.
