After Plaintiff's son told several NYPD Officers who were present in the area that he wanted to gain access to Plaintiff's home, Plaintiff explained to the officers that her son did not reside with her and that he needed to be taken to a hospital for medical assistance due to his mental illness. After several other NYPD officers, including Defendants GARCIA and GAMWELSH arrived at the scene, Plaintiff was told that she would be arrested if she did not allow her son into her apartment. After Plaintiff refused, she was arrested, verbally abused by the Defendant officers, and suffered injury to her arm and back as a result of their use of excessive force. Plaintiff was taken to the 28th Precinct and then Central Booking where the Assistant DA told the officers to remove the handcuffs and the DA subsequently refused to prosecute.
