As plaintiff walked down the block, he heard defendants shouting. Plaintiff turned around to see what was going on, and observed defendants rushing toward him. Suddenly defendants assaulted him, grabbing his arm and twisting it and forcing him to the ground. Defendants searched plaintiff on the street, found nothing illegal, handcuffed and violently put him in a police vehicle. Plaintiff was taken to the 83rd Precinct, where officers falsely informed the Kings County DA they observed plaintiff urinate in public and resist arrest, and prepared a false arrest report. At the precinct, plaintiff was put into a jail cell and his requests for water were denied. Plaintiff, an asthmatic, requested asthma medication but was threatened with a longer incarceration. Plaintiff was taken to Central Booking where he requested water and asthma medication, but both requests were denied. Later on September 14, 2013, plaintiff was arraigned in Kings County Criminal Court, where charges were adjourned in contemplation of dismissal.
