As plaintiff and his friends left the restaurant, they got into plaintiff's got. The police, including Officer Ruiz, Sgt. Thompson, and an unnamed officer, had been following the group since they elft the restaurant. They followed him through two stop lights and pulled him over for no apparent reason. Plaintiff was forced to exit the car and was asked a series of questions by Ofc. Ruiz. They as to breathalyze plaintiff. When plaintiff asked why, Ofc. Ruiz stated that plaintiff did not signal before turning, even though he did. Sgt. Thompson further demanded that plaintiff take a breathalyzer test. Sgt. Thompson told one of the passengers in the car to stay in the car or he would be tased. The unidentified officer and Sgt. Thompson then pulled out their tasers and pointed them at Plaintiff and his friend. Ofc. Ruiz handcuffed plaintiff and he was taken to to the precinct. At the precinct, plaintiff was held in a cell and was repeated pushed to complete the breathalyzer despite his stating that he was uncomfortable and had not been drinking. No one suggested probable cause. Finally, plaintiff acquiesced to the breathalyzer. Sgt. Thompson continued to harass plaintiff and ask how many drinks he had. He was not mirandized despite being at the precinct for hours. He was told he could leave and was given a ticket for insufficient turn signal. He was not told the results of the breathalyzer test.
