Later that day, several police officers approached the partygoers and told them to move the double-parked vehicles. Plaintiff went to grab a bottle that her friend was holding, and it shattered when Defendant PO Angelika Kaiser also went to reach for it.  PO Angelika Kaiser  then grabbed Plaintiff's left wrist and Defendant PO John Does grabbed Plaintiff's arms, pulled them behind Plaintiff's back, cuffed her and walked her to one of the police vehicles.  Plaintiff was transported to the 69th Precinct. \n\nDefendant PO Angelika Kaiser falsely claimed that Plaintiff had shoved her. Plaintiff was processed, fingerprinted and placed in a jail cell. Then, Defendant PO Eric Flores signed a criminal complaint falsely accusing Plaintiff of assault in the second degree, Assault in the Third Degree, Attempted Assault in the Third Degree, and Harassment in the Second Degree. Plaintiff was taken to central booking and arraigned on September 4, 2023. She was held in police custody for approximately 42 hours before she was released on her own recognizance. She was required to make approximately ten additional court appearances between September 9, 2023, and September 17, 2024. The Assault in the Second Degree Charge was dismissed and sealed on October 3, 2023. The other three charges were disposed via adjournment in contemplation of dismissal on July 18, 2024, and would be dismissed and sealed on January 17, 2025.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=Nfdy7MwCiwdqRWIQoXkZZg==","type":"complaint"}]},{"name":"Gittens, George vs City of New York, et al.","start_date":"2015-09-21","payout_amount":0,"disposition":"","docket":"506443/2015","court":"Supreme Court - Kings","officer_name":"Flores, Eric","summary":"On February 21, 2014 Plaintiff was a lawful customer at a store when the store clerk Mohammed Jbari told Plaintiff he \"hates black people\" and asked Plaintiff if he was gay using a tone that indicated it was bad to be gay. Plaintiff lawfully purchased his items and lawfully exited the store. The next day Plaintiff visited an Imam from a local mosque and told him what Jbari said. The Imam took Plaintiff back to the store where the Imam told Jbari he should be respectful of customers. Jbari responded by sticking his middle finger at Plaintiff and reaching over the counter to hit Plaintiff repeatedly in the forehead while shouting and calling Plaintiff a \"fucking faggot.\" Plaintiff and the Imam left the store and called 911. \n\nWhile Plaintiff was on the phone with 911 Jbari exited the store and began to beat Plaintiff, including by punching, kicking, stomping, pulling Plaintiff's hair, and dragging Plaintiff into traffic. The 911 operator could hear what was transpiring and there were approximately 20 eyewitnesses. Jbari knocked out Plaintiff's front tooth and Plaintiff suffered multiple bruises on his scalp, severe headaches, severe neck pain, back pain, pain to both knees, left elbow pain, and left shoulder pain. Lt. Davids, PO Eric Flores, and Sgt. Boris Durets arrived and several witnesses told the them what had transpired and that Plaintiff was the crime victim. Plaintiff also informed the police what had transpired and police viewed a video of the incident, which clearly showed that Plaintiff had committed no crime and was attacked by Jbari. Nevertheless the officers falsely arrested Plaintiff and took him to the 88th Precinct, where his injuries were treated by EMS. Plaintiff was unlawfully detained until the evening and wrongfully charged with crimes he did not commit. The charges against Plaintiff were terminated on or about December 17, 2014.
