He was left lying on the floor for an hour, begging for water, before finally being transported to a hospital for his injuries, which included one of his eyes being completely swollen shut. He was held for treatment overnight. \n\nThe following day, Plaintiff was charged with crimes he did not commit, due to the POs providing the district attorney with false information. Because he could not pay the bail, Plaintiff was sent to Rikers. After five days, Plaintiff was brought to court, where he learned that prosecutors did not secure an indictment against him. They offered Plaintiff a plea deal whereby he could plead guilty and receive a five-day sentence, or he could remain at Rikers until making bail or trial. Prosecutors threatened Plaintiff that no one would believe him if he took the case to trial. Ultimately Plaintiff took the deal and pled guilty to regain his freedom. On August 29, 2019, PO Martins, one of the officers involved in Plaintiff's case, was found to engage in serious misconduct, including covering up and fabricating evidence, so Plaintiff's case was reinvestigated. At Central booking, Vargas displayed symptoms of illness, but was denied his medication for an additional 2 hours and 40 minutes without receiving treatment before being driven to Bellevue Hospital. At Bellevue, he was given less insulin than was required by his prescribed dosage, and when, Vargas returned to Central Booking, he continued to display symptoms of illness and requested further medical care.
