During her 24-hour detention, she was denied food and water, subjected to degrading treatment, including having her hijab removed in front of male officers, interrogated about her religious practices, and missed her daily prayers. Defendant officers' request for Plaintiff to remove her hijab for booking photographs was in violation of the NYPD policy. Her personal belongings such as jewelries were also taken by the Defendant and never returned. Plaintiff was charged with grand and petit larceny based on the sworn information fabricated by Defendant Detective Huascar Morell of the Midtown South Precinct. While Plaintiff waited for his wife to pick up their daughter, an unmarked van pulled up and two unidentified Defendant NYPD officers in plainclothes exited the van, pulled Plaintiff from his vehicle, and unlawfully searched Plaintiff. The officers then searched Plaintiff's vehicle, causing $2200 in damages. No contraband of any kind was recovered. Plaintiff was transported to Midtown South Precinct and interrogated about a robbery that took place in September of which Plaintiff had no knowledge. Plaintiff was held overnight, transported to Manhattan Central Booking the following morning and then arraigned and released on his own recognizance after 24 hours of confinement. However, Plaintiff was not allowed to return to his New York residence until March of 2023, missed 3.5 months of work and was unable to see his children during this time.
