They asked him to exit his vehicle and then illegally interrogated him about contraband. Subsequently they carried out an illegal search of inside the car for 10 minutes. The Officers proceeded to violently apply excessively tight handcuffs causing him severe pain.\n\nWhen the Plaintiff asked questions about the arrest, the Officers proceeded to physically assault and battered him by jerking and yanking his arms behind his back while tightly cuffed and slamming him against the metal hood of a vehicle. The Officers punched him in the face, head and body. After the attack, the Officers tackled the Plaintiff to the ground and kicked and punched him in his head and body. They pressed all of their knees into his back as he lay on the ground cuffed. They unlawfully detained him for a further 15 minutes until medical help arrived. Defendants unlawfully stopped plaintiff's vehicle without probable cause or suspicion or warrant. Plaintiff was asked to exit the vehicle when plaintiff politely questioned why he should step outside, and he was told that he was being pulled over because of the area he was driving in. Plaintiff's vehicle was searched for contrabands, but nothing was found. Defendants then accused plaintiff of criminal offense and placed excessively tights handcuffs causing plaintiff to experience substantial pain, shock, and extreme emotional distress. Plaintiff's plea to loosen the handcuffs was ignored. Defendant, then physically assaulted and battered Plaintiff by jerking and yanking his arms behind his back while handcuffing him, slamming him against the metal hood of a nearby vehicle, and then punching and/or striking him in the face, head, and body with closed fists, causing Plaintiff to experience increased substantial pain, injury to his left pinky, head, arms, and shoulders, shock, extreme mental anguish, and significant emotional distress. Defendants, then continued to physically batter and assault Plaintiff by tackling him to the ground, kicking and punching him about his head and body, and pressing their knees and combined weight upon his back , causing Plaintiff to suffer continued substantial pain, to have his chest come into forceful contact with the hardened concrete ground, injury to his back, the aggravation of his injuries sustained just prior, shock, additional mental anguish, and significant emotional distress. The plaintiff was then detained, transported to a hospital, and later held in custody for four days, during which he was strip-searched, interrogated without counsel, and kept in poor conditions. The officers fabricated allegations to justify the plaintiff’s arrest and used excessive force which was motivated by racial bias. False arrest led to an unlawful prosecution. The charges were eventually dismissed on February 17, 2022, due to lack of probable cause. Plaintiff told Officer Hui the paperwork was in his car nearby and the officer indicated he could go retrieve the paperwork. Plaintiff began walking to the car when Defendant Farrell allegedly grabbed and slammed him to the ground. Within seconds all four officers using force including punches, and hand and harm strikes against plaintiff, who was not resisting. Eventually plaintiff was put in handcuffs by Defendant Farrell who remained on top of him, kneeling on his back for several minutes.
