Despite complying with Defendants' requests, after Plaintiff was illegally searched and after he reached to take back items Defendants had taken from his person, the Plaintiff was thereafter physically assaulted, resulting in significant injuries. The officers falsely accused the Plaintiff of resisting arrest and possessing a weapon, leading to his wrongful detention and subsequent release on bail. Thereafter, Plaintiff was forced to hire private counsel and was required to make five court appearances. A grand jury convened and returned a “no true bill”, as the prosecution’s evidence did not persuade the grand jury that that there was probable cause to believe Plaintiff committed a crime. Plaintiff was informed of this grand jury ruling that took place in July of 2023 during his final court appearance on or about September 22, 2023. Ducille was lawfully driving a vehicle in which Mesamour was a passenger. The defendants demanded both exit the vehicle, falsely accused them both of a criminal offense, then aggressively grabbed them before searching their persons, again without probable cause or a valid warrant. Defendants recovered no contraband from either Plaintiff. Defendants then violently contorted their arms to tightly handcuff them, and ignored their requests that the cuffs be loosened. Both Plaintiffs were then taken to a local precinct where they were fingerprinted, searched, and interrogated without being Mirandized. Ducille and Mesamour were in physical custody for approximately two days before their release. Defendants initiated criminal proceedings against both Plaintiffs, based on false information. He was asked to step out of the vehicle, where he was unlawfully searched and tightly handcuffed. The officers did not recover anything illegal from Plaintiff. Nevertheless, Edwards was taken to the 75th Precinct, then Kings County Central Booking where defendants falsely claimed that Edwards had been found to criminally possess a weapon. His bail was set at $15,000. Unable to immediately pay it, Edwards was sent to Rikers Island for approximately two days. After his release, Edwards had to wear an ankle monitor until his trial. Edwards was acquitted on all charges on May 2023 after a two-week-long trial. The defendants proceeded to arrest the plaintiff. During the arrest, the defendants violently grabbed the plaintiff, jerking and pulling him in different directions, and threw him to the ground, placing their knees on his back and neck without any reasonable cause. They tightly handcuffed the plaintiff, ignoring his requests to loosen the restraints. After being taken to the precinct, the plaintiff was maliciously prosecuted. The defendants' unlawful arrest, seizure, or malicious prosecutions were based on their biased discriminatory racial beliefs.
