Plaintiff sat down on a seat when an individual who was bigger than plaintiff yelled at plaintiff to \"move your shit\". Plaintiff was not preventing the individual from sitting, but plaintiff adjusted his clothing to make sure that it was not touching the vacant seat next to him. This man began to attack Plaintiff when the subway pulled into the 135th street and Lenox Avenue station. When the train doors opened the man continued to physically attack and attack him, even throwing the plaintiff to the floor. The NYPD officers boarded the train car and arrested the individual who attacked plaintiff. Plaintiff did not attack or batter the individual and the NYPD officers did not see Plaintiff assault of attack the individual. However the officers unlawfully handcuffed and falsely arrested Plaintiff without probable cause or legal justification and used excessive force against plaintiff. Police officers physically grabbed plaintiff by the left shoulder and threw him face first to the ground causing injury to plaintiff's left shoulder, face, nose and teeth. Plaintiff did not cause any public alarm by screaming on the train or platform and defendants knew that Plaintiff was the victim of physical assault. The police officers unlawfully seized plaintiff and forecefully transported him to Transit District 3 and put him in a holding cell. While there, the defendants falsely communicated to the NY DA that plaintiff did a crime and injured a police officer, and the paperwork sent to the DAs office did not reference the fact that the other person who attacked plaintiff was arrested for attacking plaintiff. Plaintiff was taken to Manhattan central booking. On november 14, 2013 after 24 hours in custody, Plaintiff was arraigned and charged. On November 15, 2013 Plaintiff went to Jacob Hospital for treatment. Plaintiff was released on arraignment. Plaintiff had to make 2 court appearances in criminal court but then all charges were dismissed against him on February 18, 2014. Diaz was struck with a baton and punched and kicked by the officers.\nPlaintiff Ayala was outside the club and complied with orders. She tried to film the melee outside the club. Ayala was approached by officers and struck in the head and face, causing her to drop her camera.  \nPena and Diaz required medical attention at Bellevue Hospital. She grabbed his arm again, pleading she was sick and needed the drugs. He shook himself free of her once more, yelling at her to stop bothering him; she was a mess; she should get into a program. Plaintiff continued across the street to his home. When he approached the door several police officers in plain clothes pounced and arrested him.
