In the process of arresting the Plaintiff, the officers exercised excessive force, which involved violently handcuffing, shoving, pushing, and slamming the Plaintiff against a brick wall as well as the hood of the officer's squad car. As a result, the Plaintiff lost a tooth, suffered a gash on his head, and, having had his shirt pulled over his head in the ordeal, lost consciousness. The plaintiff regained consciousness in the hospital, after being slapped, poked, and pushed awake by Officer Wagner. Having arrived at the hospital despite Defendant Officer John Doe 2's refusal to share David's location, Plaintiffs Scharlene and Jerome Rodriguez, David's parents, witnessed Officer Wagner carry out this assault. After threatening them with arrest, Officer Wagner pushed and thereafter tightly handcuffed Jerome. The latter suffered bruised wrists and blood pressure complications requiring subsequent hospitalization. Scharlene fainted as a result of Wagner's actions. Though police initially rationalized their arrest of David by accusing him of assaulting an off-duty officer, on July 9, 2011, any and all charges against him were dismissed.
