Prior to the police officers arriving, an individual who had previously been in the car purchased a pack of cigarettes, which they left in the center console of the car. They later returned and the occupants of the vehicle passed them the pack through the window. At this point, Defendant Officers approached the car in two unmarked police cars and unlawfully questioned Plaintiff regarding illegal activity, despite possessing no valid reason to inquire, as no criminal activity was present or even reasonably suspected. Plaintiff was handcuffed and arrested. A criminal prosecution was initiated against Plaintiff, despite the clear lack of any probable cause, and Defendant Officers forwarded their false claims to prosecutors. Plaintiff was prosecuted and the charges were ultimately dismissed.","documents":[{"url":"https://web.archive.org/web/20240719202905/https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=g6W8_PLUS_CeSsiig1crB_PLUS_Wez_PLUS_g==","type":"complaint"}]},{"name":"English, Devon vs City of New York, et al.","start_date":"2020-10-02","disposition_date":"2022-03-24","payout_amount":100000,"disposition":"Settlement","docket":"157925/2020","court":"Supreme Court - New York","officer_name":"Earl, Kevin","summary":"On October 7, 2018, plaintiff was a passenger in a vehicle near an intersection in Manhattan. Several NYPD officers, including Detective Rhyan Nelson and PO Brandon Gonzalez, unlawfully pulled over the vehicle in which plaintiff was a passenger. Another passenger and the driver were also in the vehicle. The officers falsely accused the driver of running a red light. Although the officers had no probably cause to believe that plaintiff had committed any crime or offense, they forced plaintiff and his two friends out of the car and unlawfully searched them, the vehicle, and its contents. The officers recovered a bag from the vehicle and falsely accused plaintiff of possessing the bag and its contents. A later court ruling found the car stop and search was unlawful and \"an unnecessarily aggressive escalation of a simple traffic stop that was not legally justified.\" During the course of arresting plaintiff, defendant POs Nelson, Gonzalez, Kevin Earl, Steven Kallap, and Aman Rana used excessive force, slamming plaintiff on the ground and punching him multiple times, even after he was handcuffed. Plaintiff was taken to the precinct and then Central Booking. As a result of the officers' use of force, plaintiff was treated by medical staff. After spending an extended time in custody, plaintiff's case was dismissed on November 6, 2019.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=gdG/NW0Wmc9c_PLUS_A8/nlDHFw==","type":"complaint"}]}],"discipline":[{"disposition_date":"2024-05-28","penalty":"A - Command Discipline, training, vacation days (1 day)","recommendation":"Charges and Specifications","allegations":[{"desc":"Wrongfully discourteous to an individual known to the Department."},{"desc":"Wrongfully frisked an individual known to the Department."},{"desc":"Wrongfully stopped an individual known to the Department."}]},{"disposition_date":"2022-08-03","case_no":"2021-24238","penalty":"Training","recommendation":"Training","allegations":[{"desc":"Failed to make required entries in Department logs."},{"desc":"Failed to prepare required reports."}]}],"documents":[{"url":"https://www.documentcloud.org/documents/21019855-daf-earl958539","type":"brady-giglio"},{"url":"https://www.documentcloud.org/documents/22085986-seh_958539","type":"employment-history"}],"payroll":{"salary":"119980","regular":"115444","overtime":"43575","other":"15119","total":"174138"},"id":"WKXM","url":"https://www.50-a.org/officer/WKXM"}
