Utshudi was lawfully near 1785 Story Ave. of Bronx and was not acting in any suspicious way. The officers, however, without a warrant, stopped, searched, grabbed, assaulted, battered, and detained Utshudi excessively despite knowing the lack of justifiable cause of doing so. While being detained, Utshudi was pushed, strip searched and humiliated by the officers. In conducting such a false arrest, the officers acted recklessly, negligently, maliciously, deliberately and willfully: specifically, the officers arrested Utshudi based on his race in order to satisfy their arrest quota and maliciously and falsely accused Utshudi of a crime that he did not commit. Utshudi was subsequently detained for more than 24 hours and made multiple court appearances until all charges against him terminated favorably for him. Officers' offensive and harmful beating and bodily contact has left Utshudi with physical pain and injuries on head, neck, back, body, and limb and he will continue to need medical care and medical expenses. Furthermore, Utshudi suffered from emotional harm such as scorn, ridicule, embarrassment, and reputational harm.
