Plaintiff pulled to the side of the road to take the call and Det. Nellie Maleva pulled up behind and asked to see her license and registration. Plaintiff complied and asked Det. Maleva to call Dr. Chang, to which Det. Maleva told Plaintiff to shut up. Det. Maleva was writing a summons when Sgt. Shimsky arrived and assaulted Plaintiff, hitting her in the chest, arms, and stomach, violently pulling her arm, and slamming her into the edge of an opened car door. Plaintiff told POs she was disabled, recuperating from a C. Difficile infection, and was asthmatic. POs took her medications and arrested her, informing her they did not care if she was sick. \n\nPlaintiff was taken to the 20th Precinct where she was denied use of a toilet for several hours, denied access to asthma medications and water, and denied phone calls. Det. Maleva and Sgt. Shimsky later noticed Plaintiff was bleeding from the colon but ignored Plaintiff's requests to see a judge or be taken to the hospital for more than 8 hours. PO Ross later took Plaintiff to the hospital, informing staff Plaintiff needed an inhaler and a psych consult. Plaintiff was given inhalers but they were left in the ER after Plaintiff's psych consult. Plaintiff was returned to Central Booking where PO Ross told Plaintiff to shut up several times, waving his drawn firearm at her and causing Plaintiff to fear for her life. When Plaintiff again requested a phone call she was falsely told she had already made a phone call. \n\nPlaintiff was then taken to the 7th Precinct, where she was also denied a phone call and was further struck and pulled by officers. Overnight Plaintiff experienced worsening bleeding from her colon, remained in serious pain, and became faint but was still denied water and in fact told if she was sick she would not be able to see a judge. In the afternoon of August 10 a matron called Plaintiff's husband to inform him Plaintiff was very sick and that the matron was afraid she would lose her job for making the call. Around 4:00 p.m. POs approached Plaintiff with drawn guns, informing her she could make a phone call in their car. However, they still refused to allow her to make a call. Plaintiff was arraigned and released on August 10, 2013. Plaintiff suffered serious injuries to her arm, chest, abdomen, and colon, had to be hospitalized, tested positive for Ulcerative Colitis, could not pass a stool, and a colonoscopy showed more than 50 cuts in Plaintiff's descending colon.
