At no point did any of the three plainclothes officers identify themselves as police officers. Plaintiff sustained a fracture to his zygomatic arch. He was falsely charged with two counts of possession of marijuana, obstruction of governmental administration and resisting arrest. Defendant Vorarro falsely alleged that he saw Plaintiff exchange a glassine bag for money and that he swung at the officer first and resisted arrest. Plaintiffs were taken to the 113th Precinct police station in handcuffs, they were not informed of the charges against them and were detained.  The DA had no evidence or probable cause to sustain the charges.  Plaintiffs have suffered serious injuries, pain, shock, mental anguish , and humiliation.
