Police knocked on the door and plaintiff's daughter opened the door. Police barged in explaining someone had been shot the floor below them, although no one had heard any shots. Then NYPD officer Chabert brought plaintiff and her daughter and her daughter's boyfriend in for questioning to the police station. Plaintiff and her daughter were allowed to leave the police station after 2 hours but then the daughter's boyfriend was arrested for shooting a gun causing an injury to someone in the floor below it. Plaintiff was forced to sign a permission to search form before she could enter her apartment - she was forced under duress. The charges stemmed from an incident where Jim Ocampo was robbed of a watch by three individuals in the Bronx. At the time of the robbery, the plaintiff was several blocks away from the scene with her boyfriend. The plaintiff and her boyfriend were visiting his ill mother. When they came downstairs from the mother's apartment, they were accosted by two uniformed NYPD officers on the sidewalk. The plaintiff was wearing a watch similar to the one that had been stolen. The defendant police officer handcuffed the plaintiff and seized her watch. Then, the plaintiff was brought over to an unmarked police car so that she could be viewed by whoever was in the back seat of the police car. The plaintiff was identified by the person in the back seat of the police vehicle. The plaintiff was then taken to a local police precinct where she was repeatedly questioned without her parents being present or notified. After being held in custody for over 24 hours, the plaintiff was brought before a Criminal Court Judge and arraigned on the charges. Her seized watch was returned to her.
