Defendant Police Officers John Does 1 and 2 stopped the vehicle and checked Plaintiff's wife's license.  Sergeant Manuel Fleites, an NYPD supervisor wearing plainclothes, arrived and falsely claimed that Plaintiff had been driving the vehicle.  Sergeant Fleites forcibly removed Plaintiff from the vehicle and administered a breathalyzer, which showed 0.0% alcohol.  Upon Sergeant Fleites's direction, Plaintiff was unlawfully and falsely arrested for driving with a suspended license and was taken to the 30th Precinct.  There, the officer assigned to the arrest told Plaintiff that he would not lie on the arrest paperwork about who was driving and that Sergeant Fleites had incorrectly identified Plaintiff as the driver.
