Plaintiff and his friend were arrested and handcuffed, and plaintiff repeatedly denied gambling. Plaintiff was charged just under 24 hours after his arrest with loitering and possession of a gambling device on the basis of a complaint filed by Officer Rebecca Gonzalez (not a defendant) that Defendant Officer Paul Prendergast claimed to have seen each of the defendants hold and then roll a dice and exchange money, while Defendant Officer Randys Figuereo claimed to have recovered the dice from the ground where he saw defendant Dexter drop them.
