Plaintiff felt that the police officers were being aggressive and excessive in the amount of force being used so he took out his cell phone and began to record the incident. Plaintiff eventually expressed concern to the police officers that they were using too much force. Plaintiff remained six to seven feet away from the arrest the entire time. After expressing his concerns defendant officers Patti and Hernandez approached the plaintiff and pushed him. Plaintiff was backed away from the arrest by defendant Hernandez so that he was a 15 to 20 feet away. Hernandez pushed Plaintiff again and Plaintiff responded \"do it again and I'll call your sergeant bro.\" At this point Defendant Hernandez began to arrest Plaintiff. Plaintiff was thrown to the ground and handcuffed.   Plaintiff was then taken to a precinct where he was questioned without being read his Miranda rights.
