When Price arrived, Lambert and defendant Officer Thomas Marfoglio  unlawfully seized and arrested Price, refused Price's requests for counsel, made him stand in a police line up and unlawfully guided the victim of a burglary to select Price from the line up, even after the victim initially chose someone else and said he did not recognize Price. The officers were wearing helmets and special gear, each carrying firearms. The officers entered the bedrooms where each of the plaintiffs was asleep. The defendant officers brandished guns in the faces of the plaintiffs, shouted at them, and handcuffed them. The plaintiffs asked why the officers were at the residence and what crime had been committed, but the officers did not respond other than to tell them that a detective was en route to the location. They detained the plaintiffs for several hours, searched the apartment and, turned over drawers and ransacking closets, throwing personal effects on the floor. The defendant officers opened all of the windows in the apartment, even though there was a young mother present with a baby who was only two weeks old at the time. One plaintiff, Mr. Curtis Mitchell, was taken to the 79th precinct, where he was strip-searched. He was held for several hours and then was informed by the arresting officer that he was being charged with possession of heroin. Mr. Mitchell was remanded to Rikers Island. Approximately one week later, Mr. Mitchell was released, and the charges against him were dropped. The plaintiffs allege violations of their rights guaranteed under the Constitution.
