The officers, without cause or justification, searched Plaintiff by patting him down and searching in his pockets and waistband. The officers did not find any contraband on Plaintiff’s person. After he had been released, Plaintiff kept walking and he then observed the same two officers drive by him. Soon thereafter, Plaintiff boarded a bus and paid his fare. After the bus had traveled approximately one block, PO Min Kim and John Doe 1 through 5 stopped the bus, ordered Plaintiff off the bus, and arrested Plaintiff. The arrest took place around 4:36 PM and Plaintiff was imprisoned until the evening the following day, February 19, 2012. He was then arraigned on baseless charges. The charges were based on false allegations made by PO Kim, who swore that Plaintiff had boarded the bus without paying his fare. As a result of the malicious prosecution, Plaintiff had to return to court on five occasions, until November 27, 2012, when all of the false charges were dismissed. Plaintiff had then provided proof of his fare card history, which showed that Plaintiff had swiped his card on the bus the relevant date and time.
