Desormeau or Neve appeared before a judge with a confidential informant (C.I.) to swear out a search warrant. The testimony given there was to the effect of illegal firearms previously or currently in the possession of someone at 108-25 154th Street. There are questions around if the C.I. provided truthful information in regards to the resident of that address. As a result, the judge signed a \"no knock\" search warrant. Prior to the incident date, the plaintiff has been in contact with the NYPD to discuss a neighborhood gun buyback. Plaintiff removed a shotgun and handgun from a family member's home and disassembled it in anticipation of following through with the gun buyback. On the morning of the incident date, the defendants executed a search of the incident address. In the end, the Queens Gang Squad found narcotics, drug paraphernalia, and the guns. Plaintiff was arrested and released on bail. Due to the arrest, the plaintiff was suspended from his Department of Education job and coaching positions. Plaintiff alleges that the narcotics found at his residence had to have been planted by the police. In one meeting with the Assistant District Attorney, he was told to never bring it up again or he would jeopardize any possible positive resolution of the case. Months later, the plaintiff received a plea bargain to a misdemeanor weapons possession charge and pleaded guilty.
