Plaintiff responses that the roommate had caused considerable damage to the apartment, so he retained the roommate's property to try and get compensation.  Plaintiff agreed to come to the precinct the following day to file a complaint against the roommate.  Approximately three hours later, several more officers came to the apartment with the roommate, and despite plaintiff's protests, the officers and the roommate searched the apartment without a warrant and confiscated items, including plaintiff's belongings.  Plaintiff was subsequently handcuffed and arrested for menacing, based on the roommate's allegation that plaintiff threatened him with a pistol.  Over the course of several hours at the precinct, plaintiff was repeatedly instructed to sign a document stating that he consented to the apartment search but when he refused, the defendant officers, including defendant officer Glenn Moreira, violently beat and kicked his head, body, and liver, leaving him nearly unconscious.  Over the next several days, he was transferred between Rikers Island and various hospitals due to an epileptic seizure and liver hemorrhage, which placed him at an increased risk of death due to various pre-existing medical conditions, including stage 4 liver cancer.
