The Plaintiff was concerned that the car was not really police officers and was suspicious of why he would be pulled over because he had not violated any laws. The Plaintiff put his car’s hazard lights on and drove slowly on the right line and called 911 to verify whether the people trying to pull him over were police officers. The 911 operator told the Plaintiff there were no police units attempting to pull him over. Over a public address system from the call, Hanlon and Rivera told the Plaintiff “to pull the fuck over.” The officers’ aggressive tone heightened the Plaintiff’s suspicion that they were not official officers. Hanlon and Rivera then rammed the Plaintiff’s car multiple times and threatened to push him off the road if he did not stop. They drove in front of his car and forced his car off the road. The officers never identified themselves as police officers. As the Plaintiff veered off the highway, the officers pulled in front of his car and blocked it from going forward. \n\nThe officers exited the car and approached the Plaintiff’s car with their guns drawn. Officer Rivera pressed his firearm to the Plaintiff’s temple and cursed and said aggressive things to him. Officer Hanlon also pointed his gun at the Plaintiff’s head. Rivera removed the Plaintiff’s seatbelt, pulled him from the car, threw him to the ground in the active roadway, and violently pulled him to the side of the road, pushed him into a guardrail and cursed and said aggressive things to him. Rivera told the Plaintiff he was in New York and asked if the Plaintiff was drinking or on drugs. Officer Hanlon moved the Plaintiff’s car in front of the officers’ car and searched the interior of the vehicle. Hanlon stated “there nothing fucking in there” and then questioned the Plaintiff aggressively on where something was. Rivera placed handcuffs on the Plaintiff and manhandled him. Hanlon aggressively placed a breathalyzer device in the Plaintiff’s mouth, and the results indicated that the Plaintiff was not under the influence of alcohol. Rivera continued to state that the Plaintiff was on drugs and searched the Plaintiff’s car. The Plaintiff explained that he called 911 and wanted other officers to come to the scene. The officers responded with aggressive language and then fled the scene. The Plaintiff took note of the officers’ license plate number. 15 to 20 minutes later, a number of police cars arrived and the Plaintiff was asked to go to the 50th precinct for an interview.
