The vehicle's driver had not committed a traffic infraction, and there was no reasonable suspicion or probable cause for the stop. After the vehicle was stopped, Officer Frasca ordered all occupants, including Plaintiff, to exit. Plaintiff was then forcibly grabbed, handcuffed tightly, and arrested by Officer Frasca, who falsely accused him of possessing marijuana.\n\nPlaintiff was taken to a police precinct, where he was held until transported to Queens County Central Booking on July 14, 2017. \n\nPlaintiff was released from custody later that day but had to defend himself against false charges until they were dismissed and sealed on March 22, 2018. \n\nOFFICERS, failed to intervene to prevent or end the unlawful conduct inflicted upon Plaintiff by defendant OFFICERS.\n\nPlaintiff was caused to suffer severe and serious personal injuries to mind and body, further, that Plaintiff was subjected to great physical pain, mental anguish, embarrassment, extreme shock and nervousness; which injuries are believed to be permanent in nature and duration, and Plaintiff will be permanently caused to suffer pain, inconvenience and other effects of such injuries.
