The were all asked to step out of the vehicle. Officers unlawfully seized plaintiff, searched him and the vehicle, finding a bottle of 60 pill of Oxycodone and an unfilled prescription for oxycodone. Neither the car nor the pills belonged to plaintiff. Plaintiff and others were arrested without probable cause and charged with Felony Criminal Possession of a Control Substance in the 5th Degree. Plaintiff was jailed and could not afford bail. He was in custody for 6 days, until his counsel produced the owner of the prescription.
