The Defendants entered the apartment with firearms drawn and pointed them at the Plaintiff. The Defendants were looking for the tenant, who was sleeping in the bedroom, whereas the Plaintiff, an overnight guest, was sleeping in the living room. Additionally, no weapons, contraband, or controlled substances were present in the room where the Plaintiff was sleeping. Despite the absence of any wrongdoing or resistance on the part of the Plaintiff, the Defendants threw the Plaintiff on the floor, slammed the Plaintiff against the wall, handcuffed him extremely tightly, repeatedly struck Plaintiff on the back of the neck with a baton, and told him to shut up. The Defendants who did not physically touch the Plaintiff observed these actions but chose not to intervene. \n\nThe Defendants initiated false criminal proceedings against the Plaintiff by falsely claiming they retrieved controlled substances and paraphernalia from the living room and that the Plaintiff was in possession of such items. In addition, the Defendants omitted and/or manipulated evidence and suppressed exculpatory evidence. The Plaintiff was charged for multiple crimes, including criminal possession of a controlled substance. However, the criminal charges were ultimately dismissed when the grand jury sided with the Plaintiff and declined to indict him.
